NEW YORK -- Baseball players and management hope to reach a new drug agreement this week that would increase initial penalties for muscle-building steroids and allow a decrease of suspensions for some positive tests caused by unintentional use, people familiar with the negotiations told The Associated Press. For future suspensions, the deal also would eliminate the loophole allowing Alex Rodriguez to earn almost $3 million during his season-long ban, the people said. They spoke on condition of anonymity in recent days because talks are ongoing. The sides hope to reach an agreement by Sunday, when the Los Angeles Dodgers open the U.S. portion of the major league schedule at the San Diego Padres. While the lengths have not been finalized, a person involved with the talks said Wednesday the most likely penalties would be about 80 games for an initial testing violation and a season-long ban for a second. "It will be a significant deterrent because players will know theyre not going to just easily walk back into a lineup," Travis Tygart, chief executive officer of the U.S. Anti-Doping Agency, said in a telephone interview. "It probably is the best policy in professional sports." For use of a limited group of substances, the sides were discussing giving the arbitration panel that hears appeals grievances the authority to reduce suspensions by as much as 50 per cent if the player proves the positive test was caused by unintentional use, the person said. "What were all here for it to rid sports of the intentional cheats, those who are intending to defraud both the fans and their fellow teammates, the integrity of competition," Tygart said. "You want to have provisions in place that allow for whether theres an inadvertent or a truly non-intentional situation which may arise." Since the 2006 season, the Major League Baseballs drug agreement has called for a 50-game suspension for a first positive steroids test, a 100-game ban for a second and a lifetime penalty for a third. Baseball Commissioner Bud Selig called for tougher penalties last March, and then-union head Michael Weiner said players would consider them for 2014. Weiner died in November and was succeeded by former All-Star Tony Clark, who has led the negotiations. Major League Baseballs investigation of the Biogenesis of America anti-aging clinic led to 14 suspensions last summer, including a 65-game penalty for former NL MVP Ryan Braun of Milwaukee and a 211-game ban for Rodriguez, which was reduced to 162 games in January by an arbitrator. The section covering violations not related to positive tests, which was used by Selig in the Biogenesis case, will be clarified but still will allow discipline for "just cause." Many players have advocated stiffer penalties as a deterrent. Arizona pitcher Brad Ziegler spoke out after Jhonny Peralta, who served a 50-game suspension, agreed in November to a $53 million, four-year contract with St. Louis. "We thought 50 games would be a deterrent. Obviously its not. So we are working on it again," he tweeted then. "It pays to cheat... Thanks, owners, for encouraging PED use." Some players said suspensions should lead to larger monetary losses. San Diego Padres outfielder Will Venable maintained last summer "somehow having to forfeit or void your contract that youre under is something that needs to be the main focus of the penalties." But for the majority of players, that would go too far. "Id venture to guess that even though there are concerns on a number of levels, that we will never end up in a world where player contracts are voided as a result," Clark told the AP during a January interview. Addressing positives caused by inadvertent use was a factor in the talks. Philadelphia infielder Freddy Galvis was suspended for 50 games in June 2012 for a Clostebol Metabolite, which he later claimed was contained in a foot cream he used. Reliever Guillermo Mota, then with San Francisco, was suspended for 100 games in May 2012 after taking a cough syrup with Clenbuterol. The new deal also will state that a player receives none of his salary during a season-long suspension. The current deal said a player loses as many days pay as games he is suspended. Since players are paid over a 183-day season this year, arbitrator Fredric Horowitz ruled Rodriguez was entitled to 21-183rds of his $25 million salary, or $2,868,852. "Thats fantastic," Tygart said. "You hit them in the pocketbook, and thats really where the cheaters are most deterred from attempting to steal money from the other players." Joe Flacco Jersey . Following the New York Yankees worst year since 1992, there are a whole lot of questions and not many answers. Manager Joe Girardi hasnt even committed to returning. "I dont know how its going to be here next year," captain Derek Jeter said after Sundays season finale. "The manager and coaches are free agents, too. Anything I would say about next year would be premature and speculation." New York finished tied for third in the AL East at 85-77, its poorest winning percentage in more than two decades. The Yankees were 12 games back of first-place Boston and six games behind Tampa Bay, which forced a tiebreaker for the second AL wild card. "The franchise knows what they have to do," said Cano, who may seek $300 million or more as a free agent. "They seem to make the team better every single year. Im just going to go on vacation and go home and see the family and see where we are." For a team that treats early-round playoff games as routine, missing the post-season for only the second time in 19 years was a shock. The only new memories created were tear-filled exits. "Andy and Mo, goes without saying how special that was," Jeter said. "But on the field, it wasnt memorable." New Yorks high point of 12 games over .500 was reached on the Saturday of Memorial Day weekend, when a win at Tampa Bay increased the Yankees record to 30-18. By early August they hit their midseason nadir at 57-56. Not for a single game did New York put its envisioned lineup on the field. After breaking his left ankle in the AL championship series opener against Detroit last October, Jeter didnt return until July 11 and went right back on the DL with a tight right quadriceps. He came back late in the month but played in only four games before a strained right calf caused a third DL stint. After just 17 games overall this year, his season was cut short on Sept. 11 because of another injury to the left ankle. Jeters final totals for 2013: a .190 average, one homer and seven RBIs. Coming off left hip surgery in January, Rodriguez didnt make his season debut until Aug. 5 -- the day he was given a 211-game suspension by Major League Baseball for alleged violations of the sports drug agreement and labour contract. Playing while his penalty was under appeal, he hit .244 with seven homers and 19 RBIs in 44 games and missed the final four because of sore legs. "Im really looking forward to at least one full off-season of hardcore training," he said. "I havent had that in quite a long time." Mark Teixeira partially tore the tendon sheath in his right wrist while with the U.S. team at the World Baseball Classic. The All-Star first baseman made his season debut on Maay 31, then aggravated the injury June 15 and opted for surgery on July 2.dddddddddddd His season amounted to a .151 average with three homers and 12 RBIs in 15 games. And in his last season before free agency, Granderson hit.229 with seven homers and 15 RBIs in 61 games. His right forearm was broken on Feb. 24 in his first spring training plate appearance when he was hit by a pitch from Torontos J.A. Happ. Granderson returned May 14, but in his eighth game back his left pinkie was broken May 24 by a pitch from Tampa Bays Cesar Ramos. The outfielder didnt appear in another big league game until Aug. 2. Even the replacements got hurt. Kevin Youkilis didnt play after June 13 because of a lumbar spine sprain. Eduardo Nunez was out from early May until July with a left oblique strain. Francisco Cervellis season ended April 26 when a foul ball off the bat of Torontos Rajai Davis broke his right hand. The catcher also was suspended in the Biogenesis drug scandal. New York used a team-record 56 players as 21 went on the disabled list for a total of 28 stints, causing 1,493 missed days, STATS said. The injuries and the departures of Raul Ibanez, Nick Swisher, Russell Martin and Eric Chavez as free agents caused a massive power outage. Home runs dropped from a team-record 245 last year to 144, the Yankees fewest in a non-shortened season since they hit 130 in 1989. Not counting strike years, it was the largest falloff in baseball history, according to STATS, topping a decrease of 96 for the 1988 Chicago Cubs. "I think we need more offence overall," Girardi said. Fourteen players are potentially eligible for free agency, including Phil Hughes (4-14), Hiroki Kuroda (11-13 after losing his last six decisions) and relievers Boone Logan and Joba Chamberlain. Jeter is expected to exercise his $9.5 million player option. Cano, the teams best offensive player, may opt to take a higher offer if the Yankees attempt to show fiscal restraint. Theyd like to get under the $189 million threshold for the luxury tax next season, which includes space for about $177 million in player salaries. "Ive just got to wait and see to decide if its stressful or how it is. I cannot really tell you because Ive never been in that situation," Cano said. CC Sabathia remains a concern after going 14-13 with a 4.78 ERA, 76th among 81 qualifying pitchers. The ace missed his final turn in the rotation because of a strained left hamstring. "I know a lot of people have written me off," he said. Atlanta Braves catcher Brian McCann seems to be a possible target in the free-agent market. The pitching staff could be overhauled. But if the new guys get hurt, the Yankees might struggle again. "I dont care who the guys are in that room," Girardi said. "When you put the uniform on, youre a big league player and I believe you have a chance to make the post-season."
